These Terms & Conditions (“Terms”) govern your use of firstaidcheck.co.nz and its assessment, reporting and dashboard tools (together, the “Service”), operated by First Aid Check (“we”, “us”, “our”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.
The Service helps New Zealand workplaces understand their first aid duty of care by asking about your workplace and producing a risk-based estimate of the first aiders, kits and equipment that would typically be expected, along with optional tools to record and export what you have in place. Outputs are estimates and general guidance based on the information you provide.
The assessment and on-screen report are free. We also offer optional paid Workplace Action Plans, priced by workplace complexity. Prices are shown on the site and are exclusive of GST unless stated; the GST-inclusive amount is displayed at checkout. Paid access is provided for the period stated at the time of purchase.
The usefulness of the Service depends on the accuracy of the information you enter. You are responsible for providing accurate, current and complete information and for keeping your records up to date. We are not responsible for outcomes based on inaccurate or incomplete inputs.
Payments are processed securely by Stripe. By purchasing, you authorise the charge shown at checkout. As the paid product delivers digital access immediately, refunds are generally not available once access has been granted, except where required by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you believe there has been an error or the Service was faulty, contact us and we will work with you in good faith.
You agree not to misuse the Service, including not to: use it unlawfully; attempt to gain unauthorised access to it or its data; disrupt or overload it; copy, resell or redistribute it; or use it to store unlawful content. You must not rely on the Service as a substitute for professional health and safety, legal or medical advice.
All content, design, text, logic and branding in the Service are owned by or licensed to First Aid Check and are protected by law. Documentation you generate is yours to use for your own workplace records. You may not copy or reuse the underlying Service, engine or design for any other purpose without our written permission.
The Service is provided “as is” and “as available”. To the extent permitted by law, we make no warranties that the Service will be error-free, uninterrupted, or that its outputs will meet every legal requirement applicable to your specific workplace. Guidance reflects general regulations and good practice and may not capture every circumstance.
To the maximum extent permitted by law, First Aid Check will not be liable for any indirect, incidental or consequential loss, or for any loss arising from your reliance on the Service’s outputs. Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us for the Service in the 12 months before the claim.
If you are a PCBU, you retain full legal responsibility for meeting your first aid and health and safety duties under New Zealand law. The Service is a tool to assist you; it does not transfer, discharge or reduce your legal obligations, and completing an assessment or a checklist does not by itself mean your workplace is legally compliant.
We may update the Service or these Terms from time to time. Continued use after changes are posted means you accept the updated Terms. The “last updated” date above shows when these Terms last changed.
These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute.
